29 Haziran 2022 tarihli ve 31880 sayılı Resmi Gazetede yayımlanarak yürürlüğe giren “Hakimler ve Savcılar Kanunu ve Bazı Kanunlarda Değişiklik Yapılmasına Dair Kanun” ile Noterlik Kanunu’nda da bazı değişiklikler yapılmıştır. Yapılan bu düzenleme ile noterlere taşınmaz satış sözleşmesi yapma yetkisi getirilmiştir.
Düzenlemeye göre Tapu ve Kadastro Genel Müdürlüğü’nce tapu kayıt örneği ve diğer belgeler tapu bilişim sistemi vasıtasıyla noterlerle paylaşılacaktır. Noterlerce belgeler incelendikten sonra taşınmazın satışına engel hukuki bir durumun bulunmaması halinde noterler taşınmaz satış sözleşmesi düzenleyip sözleşmeyi tapu bilişim sistemine aktaracaktır. Sözleşmenin sisteme kaydından sonra tapu müdürlüğünce taşınmazın tapu siciline tescili sağlanacaktır.
Noterde yapılan satış işleminden de tapu harcı ve döner sermaye bedeli alınacak ve ayrıca taşınmazın değerine göre 500-TL ile 4.000-TL arasında noter ücreti ödenecektir. Bu miktarlar her yıl bir önceki yıla göre tespit ve ilan edilecek yeniden değerleme oranında takvim yılı başından itibaren geçerli olmak suretiyle arttırılarak uygulanacaktır. Taşınmaz satış sözleşmeleri damga vergisinden ve değerli kağıt bedellerinden istisna tutulmuştur.
İşlemlerin başlaması için bilişim sisteminin 01.01.2023 tarihine kadar kurulması beklenmektedir. Cumhurbaşkanı bu süreyi 6 aya kadar uzatabilir.
Taşınmaz satış sözleşmesinin düzenlenmesinden dolayı herhangi bir zarar oluşur ise noterler de bu zarardan sorumlu olacaktır.
Taşınmaz satış işlemlerinin noterler tarafından yapılabilmesini sağlayan bu düzenleme ile taşınmaz satış işlemleri daha hızlı ve kolay şekilde sonuçlandırılacaktır.

REAL ESTATE SALES CONTRACTS CAN NOW BE EXECUTED BY NOTARY PUBLICS
The Law on the Amendment of Law on Judges and Prosecutors and Certain Laws was published in Official Gazette No. 31880 and dated 28 June 2022. With this new regulation the notary publics are now authorized to execute real estate sales contracts.
Pursuant to the regulation, title deed records and documents related to the real estate will be shared with notaries through the land registry information system. After the notaries review the documents, if there is no legal obstacle to the sale of the real estate, notaries will prepare a real estate sales contract and transfer it to the land registry information system. Following the registration of the contract with the information system, the land registry office will register the contract with the respective land registry records.
Title deed fees and revolving fund fee will be charged for the real estate transactions and also a notary fee between 500 TRY and 4.000 TRY which depends on the value of the real estate, will be collected by notary. These amounts will be increased each year at the revaluation rates to be determined and announced effective from the beginning of the each calendar year. The real estate sales contracts executed by notaries will be exempt from stamp tax and papers issued in relation to these transactions will also be exempt from valuable paper fees.
It is expected that the system for the aforementioned transactions will be established by 1st of January, 2023. The President of the Turkish Republic can extend this period up to 6 months.
If any damage occurs due to the execution of the real estate sales contract, the notary publics will also be responsible for such damages.
With this regulation enabling notaries to execute real estate sales contracts, real estate sales transactions will be executed faster and easier.
